- What Is An Estoppel Letter? Why You Need One For An Association-Governed Building or Community
What Is An Estoppel Letter? Why You Need One For An Association-Governed Building or Community By Christopher Carter: Real Estate Broker Associate November 2, 2023 Share When selling a Florida house or condominium located in an Association-Governed Community or Building, all parties to the sale need a dependable record of whether or not the selling owner owes any money to the Association or has any Outstanding Rule Violations. Estoppel Letters provide the necessary proof of a selling owner's account status with the Association. Because Association Indebtedness and Rule Violations follow the property, not the owner, they are a critical part of all Florida Real Estate Transactions involving Association-Governed Buildings or Communities. I am not an attorney. For interpretation and application to specific circumstances of anything you read in this article, you must speak with a Florida-licensed attorney. Buyers could "inherit" a Debt, Delinquency, or Rule Violation if the seller's Association Account status wasn't verified (and any issues resolved if necessary) before a transfer of ownership. For this discussion, "Association-Governed" means buildings and communities in which owning an individual property carries Mandatory or Automatic Membership in an Association that maintains Common Elements/Areas and manages Shared Finances. Estoppel Letters are referenced and detailed in Florida's Condominium Act (FS 718.116(8) and the Homeowners Association Act (FS 720.30851). Amounts shown in Association Estoppel Letters do not include Property Taxes, Insurance, or other recurring costs of ownership. Title companies and attorneys do check for Outstanding Property Tax Balances and Municipal Code Violations, though today's article will only discuss Estoppels related to Condominium and Homeowners Associations. An Estoppel Letter is requested by the Closing Title company or attorney. Per Florida Statutes, the cost for preparing one is currently capped at $299 with additional charges allowed for Delinquent Accounts and/or Expedited Delivery. Estoppel Letters are a seller's closing cost. Once the Estoppel has been completed and signed by a Director of the Association (or someone authorized by the Board to prepare them, like the Management Company), the Association is "Estopped" from coming back and saying that the property's owner owes more than what is shown in the Estoppel Letter. In order for the content to coordinate with a sale's closing date, an Estoppel includes the date it was prepared and for how long it is valid. As we have discussed in other articles, sellers and buyers split Association Assessments according to the closing date. A credit is given back to the seller for Prepaid Quarterly Assessments that extend past the closing date. An Estoppel Letter confirms how far in advance the seller has Paid Scheduled Assessments. (Scheduled Association Assessments are often called "Dues" or "Fees" by owners.) Example - a selling owner has already paid the 3rd Quarter (July, August, September) Association Assessment, which has been verified by the Estoppel Letter. For an August 31st closing and ownership transfer, the seller will receive a Reimbursement Credit from the buyer for September's portion of the Prepaid Assessment because starting September 1st, the buyer will be living in the property, not the seller. Only through Estoppel Letters can Prorated Payments like this be accurately calculated and supported for both parties. Most Estoppel Letters used to verify a selling owner's account status with their residential Owners Association include items such as: • Date Of Issuance and Fee for preparing it • Name of the unit or parcel owner • Subject unit/parcel identification and address • Name of person requesting it • Amount and Frequency of Regular Periodic Assessment for this unit or parcel • Date through which the current Scheduled Assessment has been paid • Date and amount of next Regular Assessment Due • Current or Upcoming Special Assessments • Other Mandatory Fees or Memberships • Outstanding Unpaid Assessments, Fines, or Interest • Unresolved Violations of Association Rules & Regulations • Signature of Association Director or authorized agent who prepared it Clearly, what is contained in an Association Estoppel Letter must be valid through the sale's closing date. Florida Statutes allow Associations 10 business days to provide them after the request is made by a Closing Title company or attorney. They are usually valid for only 30 days after the Date Of Issuance, so settlement agents can't order them either too early or too close to the closing date. Real estate attorneys tell us that once an Estoppel Letter has been prepared and accepted in good faith for use in a real estate closing and transfer of ownership, it prevents the Association from collecting amounts that are in excess of what was detailed in the letter. There we are, a very brief introduction to Estoppel Letters and why they are used. With so many Condominium Buildings and Association-Governed Communities in Florida, thousands of Estoppel Letters are prepared every day. They perform an essential function in the sale of properties throughout our State. Editor's Note: Christopher Carter is NOT an attorney. He does not give legal advice. - Hurricane Season Begins This Week: Stay Informed And Be Prepared
Hurricane Season Begins This Week: Stay Informed And Be Prepared May 31, 2023 Share Thursday, June 1st marks the start of the 2023 Atlantic Hurricane Season. A hurricane can cause major headaches for you and your family - power outages, long lines at gasoline stations and supermarkets, limited medical supplies, not being able to stay informed, etc. The best way to minimize these and many other problems is to be prepared. Don't wait until a hurricane threatens our region to think about what you need to safeguard you and your family. Families should be finalizing plans now to determine essentials such as how much water your family needs, where you will go if you need to evacuate before a storm hits and how you will stay in contact with loved ones. Some important points to consider when preparing your hurricane plan and gathering supplies: • Self Sufficiency: Plan on being self-sufficient for at least seven days after a hurricane hits your area. Emergency crews and government agencies will likely be tending to the hardest hit areas, so you should not rely on their assistance immediately following a storm. Organize your hurricane kit at: https://www.ready.gov/kit • Evacuations: Do you live in an evacuation zone? If so, do you know where you will go if an evacuation order is issued for your area? Only go as far as you need to get to a safe location. Leaving the county and driving long distances is not advisable. A storm may change direction at any time, and debris scattered by a storm may make returning extremely difficult. • Don't Plan on Evacuating? Help Us Notify Your Loved Ones If You Don't Survive: If you live in an evacuation zone but do not plan on heading to a safe location following an evacuation order, the City of Hollywood respectfully requests to help first responders identify you and notify a loved one if you do not survive the storm that you submit a Next of Kin Information Form by visiting: https://www.hollywoodfl.org/FormCenter/Emergency-Management-Next-of-Kin-Informa-28/Next-of-Kin-Information-Form-308 • Shelters: Going to a hurricane evacuation shelter should be considered a last resort. They can get full and do not have the comforts of a friend's or relative's home. • Evacuation routes and zone map visit: https://www.broward.org/Hurricane/Pages/EvacuationRoutes.aspx • Evacuation shelter information visit: https://www.broward.org/Hurricane/Documents/PI201867423EmergencyMapA.pdf • Emergency Contacts: Establish reliable emergency contacts inside and outside our region to ensure that your loved ones know the status of you and your family. • Special Medical Needs: Have a relative with special medical needs? Be sure to make appropriate arrangements for them. You also can register them for accommodation at a Special Medical Needs Shelter, visit: https://www.broward.org/AtRisk/pages/specialneeds.aspx To request or obtain an application for a Special Needs Shelter and/or Paratransit evacuation transportation, including applications in alternative formats, call Broward County Emergency Management at: (954) 831-3902 Or TTY at: (954) 831-3940. Need prescription medication following a hurricane/emergency? Learn what pharmacies are open in your area during an emergency by visiting: http://www.rxopen.org/ • Pets: Don't forget your pets! Make sure you have enough food and water for them and you keep them indoors with you during a storm. If you have to evacuate and would like to inquire about placing your pet in a pet-friendly shelter, please call the Humane Society of Broward County at: (954) 989-3977. Born and raised in Haiti, Self-Taught Artist Sophia Lacroix migrated to the U.S. at the age of 15. Lacroix creates hyper-realistic oil paintings and charcoal drawing scenes of everyday life and her nostalgic memories of Haiti. The opening reception will be held Saturday, August 19th, 2023 from 5:00 p.m. – 8:00 p.m. The Exhibition will be on display from Saturday, August 19th, 2023 – Friday, September 29th, 2023. Lacroix was selected for a solo exhibition from the 2022 Florida Biennial. The 11th edition, entitled 2022 Florida Biennial: Installations, Portraiture, Materiality, and Magic Realism was juried by Ylva Rouse, Senior Curator at MOCA Jacksonville. Rouse reviewed over 1,000 submitted works from 349 artists from throughout Florida. From the large number of submissions, 24 artists representing eight Florida counties were selected by Rouse. Lacroix was chosen from the 24 artists to present a new body of work at the Center. This exhibition reveals highly detailed portraits of people in everyday routines and activities inspired by Lacroix’s memories of Haiti. Figures are often surrounded by abundant fruits, handwoven baskets, and tropical plants. The laborious detail is mirrored in the images themselves, indicating both the beauty and conviction in the figures conveyed. Sophia Lacroix was included in the Exhibition Introspective: A Reckoning of the Soul curated by Marie Vickles at the Center (2021). Outdoor public projects include a large-scale mural commissioned by the City of Miami at the Little Haiti Cultural Center (2008) and a wrapped utility box organized by the U-Wrap NoMi Art in Public Places Initiative by the City of North Miami Community Redevelopment Agency (2021). Her work has been published in several magazines, books, and newspapers, including the book Here, There...and Beyond: The Work of 16 Haitian Artists of Florida (2009). - The Year of The "Shovel": The State Of The City Part V
The Year of The "Shovel": The State Of The City Part V By Hallandale Beach Mayor, Joy Cooper July 6, 2023 Share This article is part of The State of the City Part V. This portion covers the Infrastructure plans we have to address water supply, sewer, and stormwater. It is in speech form. Since the writing of the speech, we have adopted the city tentative budget and have adopted the new water utility rate to cover our Utility Revenue Bond. In August I will cover our new budget and these rates. This coming year, I am calling it, the year of the “shovel." There was not one large Infrastructure project that was completed in years. The last large-scale project installed was the critical stormwater system in the Northeast and Southwest sections of the City. After this last 1000-year storm, while we flooded, our City was free from flood water much sooner than many surrounding communities. The Southwest area actually had high water, but did not flood. We know that there is still one area that is one-foot above sea level that needs to be addressed further. Plans are underway for a joint project with Hollywood to address pumping in the northeast along Atlantic Shores. We have also funded for repairs to the section of Northeast 3rd Street that floods. Eight years ago, six million dollars in the water utility fund was budgeted to add a skid at our water plant. It sat there and not one action was taken to implement construction. This skid is vital to address the future of our water supply. The leadership of Jeff Odoms and his team of engineers and operators have been doing an amazing job gearing up for this and many projects. This year our City approved the first twenty million dollars in revenue bonds to replace many broken water and sewer pipes, valves, and lift stations. Many over 40 to 50 years old. We have prepared for these costs by hiring an outside bond counsel that specializes in rate structuring and adopted new fees. This too took political backbone from this commission to do the right thing. We all unanimously supported these changes. It is the biggest and most important "can," or should I say "can," we stopped kicking down the road. Yes, we have had multiple water breaks, but they all were fixed and up in running within hours due to the hard work of staff. If you see them please give them a big thank you. In addition to funding the beginning of a 10-year buildout, we have had great success due to our planning and have received state funding to help offset these costs. A special thank you goes to our hardworking legislators, including Representative Woodson and Representative Cassel. Regretfully, due to the remnants of COVID-19, and the war, we are still adversely impacted with supply chain and manufacturing issues. There is also a high demand on engineering. These projects are getting designed, and some are finally out for construction bidding. So, you can see we really have been focusing on establishing stability across the entire city while investing in our future. We know everyone in our community has been burdened with added costs. Our city is no different and we continue to make sure we run a tight ship and oversee every tax dollar. That brings me to opportunity! With the stability of our government, we are keenly focused on cost saving measures without adversely impacting our level of services. We have also committed to leveraging our assets to create future revenue streams. These revenues can help take the pressure off our General Fund. I look forward to sharing these concepts in the future months. One big step towards preserving and protecting one of our biggest assets, our employees, was taken thru a wage and compensation study. In this highly competitive market, we need to not only recruit new talent, but we also need to ensure we retain the excellent industrious men and women we have now. These recommended changes, which were budgeted partially last year and will be included in this year’s budget. Ground has been broken on some amazing developments this year and some have opened this past year. Atlantic Village 4 and Optimum Tower, Two thousand Ocean Phase 1 of Oasis and Slate. There are also many exciting plans in the pipeline. Please visit our website to find out more. I must mention that with the opening of 2000 Ocean, Hallandale Beach now can boast real estate values at well over $1000 square foot. In Golden Isles parcels and older homes are selling for 3-4 million dollars and the new homes going up are for selling for over five million. Values are going up, but that is a double-edged sword. City Center on Dixie Highway is being built as we speak and with the Opening of the very First Container Restaurant in Broward, KAO, we kicked off recently in District 8. We have a wonderful CRA that is here to help businesses grow through loans and grants. The CRA is 90% complete in design of twenty-two million dollars for improvement in: sidewalks, lighting, & ADA crosswalks throughout the district. More investment in our neighborhoods and future. I am not going fully into the CRA, as I have discussed the goal with our City Manager to set up a CRA briefing and development forum in the coming months. As always, I am available for your questions, concerns and ideas to help make our City a better place. Please feel free to reach out to me at my Office: (954) 457-1318. An eclectic group of six mid-pubescents vie for the spelling championship of a lifetime. While candidly disclosing hilarious and touching stories from their home lives, the tweens spell their way through a series of (potentially made-up) words, hoping never to hear the soul-crushing, pout-inducing, life un-affirming “ding’ of the bell that signals a spelling mistake.
