    Advice From A Cape Coral Resident: Hurricane Season Is Over, So Now Is The Time To Prepare December 8, 2022 Share Like many Americans, when Will Seippel started to think about where he might want to live for retirement, Florida was at the top of his list. In 2021 Seippel, the founder of WorthPoint, the world's largest provider of information about art, antiques and collectibles, bought a house in Cape Coral, Florida. When Hurricane Ian reached Florida on September 28, his new house was left standing — but waterlogged. "We hadn't had a hurricane down there of any severity for 100 years," says Seippel. "And lo and behold, the second hurricane season I'm down there, a hurricane comes, and the storm's center is where I live. We had eight and a half hours of 100 mph-plus wind." The house remained intact, but wind and water saturated the walls, causing mold. The resulting damage will require the home to be gutted and rebuilt. Seippel isn't alone. According to FEMA, 40% of Americans live in a disaster zone or state. Add to this the fact that 80% of Americans file insurance claims caused by weather, to the tune of $152 billion a year. As for the possessions in the house, Seippel says it's ironic that he owns a company with a database "vault" that allows users to capture the items they own with images and text as evidence for insurance. "There are a few ways to lose your stuff in a natural disaster. They can be stolen, they can be washed out with the storm, or they can have water damage. If the water damage is not taken care of, mold can set in," says Seippel. Seippel has hundreds of collectibles, art and other possessions that were damaged in the storm. "I'm glad I had a photo of them and description in the vault, as concrete evidence for the insurance," says Seippel. Seippel offers his steps for preparing your house and the stuff in it in case disaster strikes. According to Seippel, the steps include: Step One: Do a walkthrough and create an inventory. Inventory your possessions by going through every closet, drawer, shed and garage. List each item, including clothing, accessories, electronics, appliances, furniture, decorations, linens, artwork, hobby items, collectibles and heirlooms. Step Two: Take photos and add notes. Once your list is made, go back over the items, take a picture of each article or group of objects, and any relevant notes, including make, model, serial number and dollar value if you know it. List the store and year purchased. Step Three: Gather your documents. For larger purchases such as furniture, appliances, jewelry, art and collectibles, scan the documents and save them to a specific folder on your computer. Step Four: Record a video. Go through and take a video of everything as further proof of your ownership and its condition. Step Five: Compare your list to your current insurance policy and work with your agent to make sure you have the type of insurance and enough coverage for what you own in the event of a disaster. Step Six: Update your inventory. As you acquire new possessions, be sure to update your inventory record.     Who's The Boss? Association Board Or Management Company By Christopher Carter - Real Estate Broker Associate July 13, 2023 Share It is essential for everyone buying into (or already living in) a Florida Condominium Building or residential community governed by an Owners Association to fully understand the relationship between their Boards and their Management Companies. Today's discussion applies to Associations in which membership is mandatory (and attached to) buying and owning in a residential condominium building or an HOA community. These Associations are regulated by Florida Statutes and each one's Governing Documents are recorded with the local County. Many new owners and seasonal residents are realizing they are not familiar with how their Associations function and are regulated. Some admit they have never even looked through their Governing Documents. After the catastrophic structural failure and deadly collapse of Champlain Towers South Condominium Building in June 2021, the interaction and dynamics between Association Boards and their managers or Management Companies have come under close examination. Short answer: The Board of Directors has final authority over the manager and Management Company. Now let's discuss why. The Florida Condominium Act (Florida Statutes Chapter 718) and Homeowners Association Act (FS Chapter 720) place fiduciary duty on Board members to always act in the best interest of the Association as a whole, placing the financial and administrative well-being of owners above the personal interests and opinions of individual Directors. This means that Board members must make decisions and conduct Association business for the greater benefit of all Association property owners. Directors accept this fiduciary responsibility when they are elected or appointed to a seat on the Association's Board. Florida Condominium and Homeowners Board members (Directors) are unpaid owner-members in the Association who have voluntarily run for a seat on the Board and been elected under the provisions of the Condominium or Homeowners Association Act and the Association’s own Governing Documents. The elected Board must function as a group. Individual Directors cannot make decisions regarding Association business on their own. All decisions that legally or financially affect the Association must be made during a properly noticed and conducted Board of Directors meeting. (Pretty much everything that comes up has a legal or financial effect on the entire Association.) The Condominium and Homeowners Association Acts allow (do not require) Boards to contract with property managers and management companies to help the Board maintain the property and assist in its administration. Here in Florida, managers and Management Companies working for COA’s and HOA’s must have valid Community Association Manager or Community Association Management Firm licenses issued by the Department of Business & Professional Regulation (DBPR). Managers and Management Companies are expected to provide the professional services outlined in their contracts with the Association, though do not have the same fiduciary relationship with owners as do elected Board members. Managers and companies work for the entire Association, taking their guidance and instruction from the Board. When an Association decides to hire an individual licensed manager and maintenance staff as employees, the Association is responsible for withholding taxes, Social Security contributions, and other employment costs. Under this arrangement, the manager and staff answer directly to the Association's Board of Directors. When an Association decides to contract with a licensed Management Company to oversee administration and maintenance, one of the company's licensed managers is assigned to the Association. In this case, the Property Manager is an employee of the Management Company and the company is a contracted vendor to the Association, providing the professional services agreed to in the management contract. Under this arrangement, your Association's Property Manager may also be the Property Manager for a few other Associations at the same time (this is called being a portfolio manager). There are advantages and disadvantages to each of these arrangements. When considering which may be best for your Association, it is critical to receive input from the Association's attorney and accountant. As long as their own Governing Documents and State law are properly followed, it is up to each Owners Association and their Board to decide whether they prefer to “self manage” (Board directly runs Association business without a manager) or pay a licensed manager / Management Company to help them with the ongoing operation, administration, and maintenance of the property and community. Hiring a management company or manager does not relieve the Board of its own responsibility and obligation to maintain Association property and common elements, and to conscientiously direct Association finances and governance. Examples of services that managers and Management Companies provide to Boards and Associations include: • Processing owners' payments • Arranging and overseeing property maintenance • Scheduling Association meetings • Monitoring compliance with regulations and procedures • Managing Association financial accounts (under Board direction and oversight) • Communicating Association business to all owners Without a manager or Management Company, the Board is responsible for carrying out all these operational tasks. Therefore, all Florida COA’s and HOA’s must have a Board of Directors, though there does not have to be a manager or management company unless the Association decides it wants one. In practice, Associations are NOT advised to "self manage" (no manager at all). There are FAR too many critical details involved with the efficient operation and governance of a residential Owners Association for untrained, unlicensed owners and Board members to properly address without professional assistance. Problems arise when Boards either intentionally or unknowingly give managers and management companies too much authority and independent decision-making ability. Boards doing this can be thought of as abandoning their statutory and ethical Directors' responsibilities by trying to transfer them to third-party management. Depending on the severity and the outcome under this type of circumstance, property owners may be able to bring charges of breach of fiduciary duty against the Board. Directly related to this is when Boards do not keep a close enough eye on what managers and Management Companies are doing. A prime example is the 2021 Collier County case in which a licensed Community Association Management Firm was charged with embezzling millions of dollars from the accounts of about 35 different COAs’ and HOA’s. In my opinion, this theft could have easily been prevented through proper Board oversight of manager / Management Company function and Association finances. This appears to have been a fiduciary breach (or negligence) by multiple Associations' Boards which resulted in a third-party's criminal behavior and significant loss of owners' money. There we are - a quick overview of the relationship between Association Boards and managers / Management Companies. As mentioned in multiple previous Association-related articles - the keys to owning and living in a Florida Association-governed building or community are education and participation. According to new research from TopCashback, nearly 7 in 10 Americans no longer consider Black Friday a one-day event, viewing it instead as a month-long shopping season. Only about one-third still see it as a single-day tradition. More than half of respondents said they now shop online instead of in stores and 43% start scouting deals in early November. Findings suggest Black Friday's sense of urgency has shifted, replaced by a steady flow of rolling discounts and digital promotions. What was once a race for the best bargains has become a marathon for savings. The evolution of Black Friday appears to be changing how people spend, too. While 18% of shoppers said they spend less now than they did five years ago, another 18% said their habits haven't changed much. Only 3% reported spending more. For many, the shift seems to be less about budget and more about timing. Asked whether they'd prefer Black Friday return to a single-day event, 44% said they like having more time to shop, while 26% said a one-day version would feel "less overwhelming." The rest simply don't mind either way. "Consumers are rethinking how they approach major sales events," said Destiny Chatman, Consumer Analyst at TopCashback. "They still want value, but they're less willing to be rushed. The new Black Friday is about planning, timing and feeling in control of spending." The research also found shoppers are increasingly aware of the marketing tactics behind the hype. Two-thirds said they believe brands create fake urgency around Black Friday and another 30% said they think it happens "sometimes." Despite the skepticism, most still admit deep discounts drive their decisions - nearly 87% said upfront savings are their top motivator, compared with just 6% who said they're most influenced by cash back or rewards. Still, money-back incentives aren't without impact. Four in 10 respondents said they've made a purchase specifically because cash back was offered, and about half said they'd consider choosing a smaller discount if it came with meaningful rewards. Electronics and tech ranked as the top categories where shoppers expect to earn the most cash back, followed by fashion and beauty. Even with the season stretching longer, the emotional rollercoaster of Black Friday remains. Most respondents said they feel neutral after shopping while 33% said they feel proud of the deals they scored. Smaller groups reported guilt or regret after their purchases. Impulse buying persists with more than 62% saying they occasionally buy things they didn't plan to, and nearly 1 in 5 said it happens most years. Still, only 5% said they always feel pressured by sales, though 39% said they sometimes do. For 68% of shoppers, seeing a huge percentage off is what makes them feel best about spending. Another 8% said they enjoy feeling like they "beat the system" and 7% said earning cash back brings them satisfaction. "People want to feel proud about their spending," Chatman said. "They're realizing that a good deal isn't just about price in this economy. It's about timing, confidence and getting something that feels worthwhile." If Black Friday disappeared altogether, 55% of Americans said they'd be indifferent. Only 31% said they'd be disappointed while 13% admitted they'd feel relieved to skip the pressure. For all its changes, Black Friday still reflects the psychology of modern spending: the balance between excitement and restraint, hype and habit. Experts say shoppers can make the most of the season by planning ahead, comparing prices over time and focusing on rewards that add long-term value rather than chasing every flash sale.
