    Listing Your Property For Sale? Florida's Best-Kept Real Estate Secret By Christopher Carter - Real Estate Broker Associate August 24, 2023 Share Every year, thousands of Florida property owners agree to have local real estate agents list and offer their houses and condos for sale to the public. While reviewing their Listing Agreements, just about all of them notice that the relationship between seller and Broker has been designated as “Transaction,” which is the default brokerage relationship in Florida unless another is agreed to in writing. Listing agents explain to sellers that in residential sales, the Transaction Broker relationship is a limited form of representation in which a real estate agent can assist the seller, the buyer, or both by having all parties give up their rights to that agent’s undivided loyalty. An agent working under a Transaction Broker relationship does not represent either a seller or a buyer in a fiduciary capacity or as a single agent. Florida’s Transaction Broker relationship is described in Florida Statutes Chapter 475, Section 278. It is interesting to note that unless another form of representation (Single Agent or No Brokerage) is specified by separate written disclosure, a Transaction Broker relationship is established between a seller and a listing agent's Broker when the Listing Agreement is signed, long before the property is even offered to potential buyers. In Florida, all relationship agreements for residential real estate services are between a principal (seller or buyer) and the office's Broker, NOT with the individual real estate agent who will be dealing directly with the seller or buyer. Any form of brokerage relationship (Transaction, Single Agent, or No Brokerage) applies to all agents whose licenses are attached to that Broker and office. Keep in mind that the sales commission received by a buyer's Florida real estate agent is paid by the seller. In the Listing Agreement the seller agrees to pay a negotiated total commission to the listing office at closing, which is then shared with the buyer's real estate agent's office. This is called a cooperative commission. The Transaction Broker relationship does not require a separate written disclosure to principals in order to apply. All relationships between Brokers and sellers/buyers in Florida are automatically Transaction unless and until a separate written disclosure changes it. (That's the "best-kept secret" part.) This is how the Florida Statutes (see the above link) describe Transaction Brokerage: " (b) Presumption of transaction brokerage. — It shall be presumed that all licensees are operating as transaction brokers unless a single agent or no brokerage relationship is established, in writing, with a customer. 2) TRANSACTION BROKER RELATIONSHIP. — A transaction broker provides a limited form of representation to a buyer, a seller, or both in a real estate transaction but does not represent either in a fiduciary capacity or as a single agent. The duties of the real estate licensee in this limited form of representation include the following: (a) Dealing honestly and fairly; (b) Accounting for all funds; (c) Using skill, care, and diligence in the transaction; (d) Disclosing all facts that materially affect the value of residential real property and are not readily observable to the buyer; (e) Presenting all offers and counter-offers in a timely manner, unless a party has previously directed the licensee otherwise in writing; (f) Limited confidentiality, unless waived in writing by a party. This limited confidentiality will prevent disclosure that the seller will accept a price less than the asking or listed price, that the buyer will pay a price greater than the price submitted in a written offer, of the motivation of any party for selling or buying property, that a seller or buyer will agree to financing terms other than those offered, or any other information requested by a party to remain confidential; (g) Any additional duties that are entered into by this or by separate written agreement." A Single Agent relationship includes the fiduciary duties of Loyalty, Obedience, and Confidentiality, while a Transaction Broker relationship does not. Transaction brokerage is non-fiduciary and involves "Limited Confidentiality" as mentioned above, which is a confusing concept to many sellers, buyers, and even real estate agents. Listing Agreements indicating (or defaulting to) Transaction Brokerage establish the relationship with sellers. However, if buyers have not signed a Single Agent or No Brokerage agreement with their real estate agent's Broker, Transaction Brokerage status automatically extends to their representation relationship. Local real estate Boards refer to Transaction Broker limited representation as “facilitating” the transaction and “assisting” both seller and buyer, which includes filling in some paperwork, arranging access for viewings and inspections, and referring both sides to attorneys or title companies for closing. Under a Transaction Broker relationship, buyers and sellers are referred to as "customers," not clients. Licensed Brokers who manage offices and Sales Associates often call this a "non-agency" relationship. Transaction agents are expected to provide marketing services and property/market information in order for sellers and buyers to make an informed decision on their own. Providing negotiation suggestions and/or advice may be interpreted as overstepping the limitations of a Transaction Broker relationship. Transaction agents can be viewed as neutral third parties helping both the buyer and the seller navigate a Florida real estate deal. Real estate attorneys tell us that handling sales under Transaction Broker relationships reduces potential liability on Brokers, offices, and companies for agent errors and omissions. The majority of real estate agents in Florida operate as non-employee independent contractors to the companies where their licenses are attached. One of the reasons Florida real estate agents like to operate within a Transaction Broker relationship is because it opens the door to handling both sides of the deal and receiving both seller-side and buyer-side commissions. To many of them, the "holy grail" jackpot is receiving commissions from both the seller side and the buyer side in the same transaction. Unless established in writing through a separate Single Agent disclosure, Florida real estate agents do not work for individual sellers or buyers, they work to help complete the transaction for both parties. When Transaction agents give sellers or buyers advice or opinions about whether an offered price is too low, whether or not to counter with different terms or price, or which side should pay for certain negotiable items, they may be overstepping the limits of their Transaction Brokerage relationships. This could be interpreted as implied agency and is the basis for many misunderstandings (and sometimes lawsuits) between buyers, sellers, and their agents/Brokers. Speak with a Florida-licensed real estate attorney for details on agency relationships and implied agency. Even when one Transaction agent handles the seller side, and a different one handles the buyer side, both agents are there as neutral parties to facilitate the transaction and assist (not advise) both the buyer and the seller. Either one may be creating implied agency by not adhering to the limitations of Florida's Transaction Brokerage relationship. Being the default real estate brokerage relationship in Florida, Transaction Brokerage is valid, accepted, and works adequately when properly adhered to, then competently and ethically applied in actual practice. Issues and misunderstandings arise when one side (seller or buyer) feels that their interests have not been looked after or protected as well as they assumed or expected. When interviewing real estate agents to handle your side of an upcoming deal, be sure to have each one discuss Florida's Transaction Broker, Single Agent, and No Broker relationships with you. Depending on how you would like your interests addressed, you should know the differences and have the opportunity to ask basic questions. Both Presidents Biden and Trump were correct, and it’s time we stop this bipartisan assault on their foreign policy decisions related to our withdrawal from Afghanistan. We must shift our resources (both military and financial) from nation-building to preparedness for a militarizing China. We’ve all seen the disturbing images of desperate people trying to escape Afghanistan and the Taliban committing acts of brutality against peaceful protesters. As tragic as that is, we must accept that our withdrawal was the correct decision. Afghanistan was a losing proposition and remaining there ran counter to our own interests and national security. Both presidents realized this and had the conviction to act. We lost countless Americans and spent billions of dollars for nothing; it is not the job of the U.S. to spread democracy and be the global protector of human rights. A better allocation of those resources is toward the Pacific to prepare for our greatest threat, a militarized China. The Taliban was able to take complete control of Kabul and its six million citizens in just 10 days without force. For the most part, they were welcomed into the city by countless Afghans, and their success left most American bewildered, angry, and heartbroken. We wanted to share the American dream where hard work and dedication can give one a better life. Where differences are protected by a constitution that ensures equality for all. We wanted girls to be protected and educated and able to determine their own futures. We naively assumed the Afghans wanted this too. How can we expect Americans to die protecting Afghani freedom when they refused to fight for their own? Their military and security forces simply ran away, and their democratically elected president fled like a coward. We did not betray the Afghani people. We left every building-block they needed to establish and protect their democracy and they simply refused. We’re all left wondering, what was our national sacrifice for? It is clear there was no strategic plan to evacuate Americans and others from Afghanistan before the set deadline, as evidenced by the images we see on the nightly news. Despite this chaotic situation, more than 120,000 Afghans have been airlifted to freedom and that is something positive. The American people are welcoming Afghani refugees, and this compassion shows who we are as a people, and we should be proud. It is time we give both Biden and Trump the credit they deserve for putting American interests and security first, something their two predecessors failed to do. President Bush created a constitutional democracy with a strong central government and weak provisional governments. This was his first and biggest mistake. What Afghanistan needed was something akin to our pre-constitutional republic; an Articles of Confederation where the federal government was weak, and the provinces and tribal regions had the bulk of the power. Under President Obama, billions of dollars were poured into a corrupt system where Afghan politicians enriched themselves and their friends, ignoring the needs of Afghani people. In part, this explains why the Taliban were able to gain control with almost no opposition. Now that we’ve exited Afghanistan, it’s essential we turn our attention to China and start taking their military expansion more seriously. Over the last 20 years as we have attempted to nation-build, the Chinese significantly increased their military, developed high-tech weaponry that can reach our borders, tripled their navy, and successfully built islands in the Pacific to use as military bases. They have not wasted their capital, time, resources, or lives on nation building or spreading democracy; their resources go to ensuring their own national security. We’re out of Afghanistan now. Our military must remain vigilant, and we must keep American interests as our main priority, or the next hot spot we’ll have to deal with will be China. Sullivan, author of Buddy Leads the Way. He will be available to meet guests and autograph copies of his book on Saturday, March 15, from 11 a.m. – noon. His appearance is part of History Fort Lauderdale’s “Florida Scribes & Stories,” a meet the author series that offers literary and history enthusiasts a chance to speak with local authors, purchase their latest releases and have them signed. Frank P. Sullivan has been a member of the fire service for over 50 years as a volunteer and paid first responder. He was third generation fire fighter, starting as soon as he turned 18, volunteering in Haverstraw, New York. After moving to Florida in 1973, he switched from construction and was one of the original five hired firefighters in the City of Miramar in 1975. During the years at Miramar, his dalmatians became mascots and served the city as well. He was Fireman Frank and enjoyed teaching fire safety in the public schools, children’s hospital and nursing homes as part of his job. His love of the fire service is evident in his historical accounting of how Dalmatians became fire dogs. Sullivan retired from Miramar as a captain in 2005 and can be seen around town with his current dog, Buddy, and his 1934 restored antique fire truck. Drinks and light bites will be provided. Despite these added costs, we ensure our menu prices remain competitive. MK: How does Gallaghers Boca Raton reflect the legacy of the iconic New York location? MK: Can you explain the restaurant’s dry-aging process and its impact on the flavor of the steaks? A: Dry-aging and butchering on-site is what gives a steak that nutty flavor that so many enjoy. Our dry-aging process occurs in a glass-encased meat locker on-site, which is kept below 36 degrees Fahrenheit with controlled humidity. This prevents mold and bacteria growth while intensifying the beef's flavor and tenderness. At any given time, our meat locker can hold 2,800–3,800 pounds of beef. This traditional process, combined with our hickory coal grilling, ensures an unparalleled dining experience. Fresh meat is received in NYC and shipped to Boca and dry aged for 28-30 days. Because of that, the flavor is what is called “nutty flavor” as opposed to a “musty” flavor. MK: What are your top-selling seafood dishes? A: Our seafood selections rival our prime steaks in quality and popularity. Favorites include jumbo lump crab cakes, Hamachi crudo, shrimp and lobster dumplings, and fresh catch entrees like Dover sole, and salmon. Our lobster tail, particularly as part of a surf-and-turf pairing, is a perennial crowd-pleaser. MK: How does Gallaghers cater to guests with dietary preferences or restrictions? A: Our team is trained to customize dishes to accommodate dietary needs. We’ve earned a very good reputation of service here in South Florida. Many of our guests ask for our servers by name, so it has become like a club atmosphere in that sense. The music we play also makes people feel as it they’ve been transported to a place in time. MK: Can you share a bit about the history of Gallaghers Steakhouse? A: Gallaghers began in 1927 as a speakeasy on Manhattan’s 52nd Street, founded by Broadway showgirl Helen Gallagher and gambler Jack Solomon. After Prohibition, it evolved into a steakhouse frequented by Broadway stars, bootleggers, and politicians. Though it changed hands over the years, the restaurant has remained a bastion of mid-century charm and culinary excellence, with the current owner, Dean Poll, restoring it to its former glory. MK: What selection represents a personal favorite dish on the menu? A: Owner Dean Poll’s go-to order is a chopped wedge salad, rare sirloin steak, creamed spinach, Brussels sprouts, hashed browns, and cheesecake for dessert. MK: What should people know about Gallaghers that they might not? A: Many don’t realize the original Gallaghers in New York started as a speakeasy during Prohibition. Additionally, our walls are adorned with photographs of famous guests that have dined here throughout the years- spanning nearly a century, including actors, Broadway stars, athletes, and politicians. When Things Don't Go As Planned Or They Feel Overstimulated Or Face New Experiences, Children May Respond With Anger And Frustration, Fueled By Feelings Of Shame, Embarrassment Or Even A Sense Of Injustice. Because young children often don't have the language or regulation skills to handle these big feelings, they can result in tantrums, mood swings, rebellion and emotional outbursts, which may trigger feelings of embarrassment and exasperation for parents. Fear not; every parent has been there. Dr. Lauren Loquasto, Senior Vice President and Chief Academic Officer at The Goddard School, and Kelly Oriard and Callie Christensen, co-founders of Slumberkins and authors of "All Feelings Welcome," share guidance to help parents effectively deal with these situations. Managing Meltdowns Parents are most effective when they stay calm, speak quietly and move slowly. Counterbalance your child's extreme emotion and behavior with the opposite extreme. Take deep breaths and stay near your child while the emotion dissipates. Scolding only heightens the emotion, so start with empathy, not discipline, and affirm the feelings. For example, "We all get angry sometimes," or "It makes sense that you're feeling this way." Help your child label feelings and seek to understand what caused the outburst. Try "sportscasting" - objectively narrating what you see. For example, "I see you taking deep breaths. I see your cheeks are puffed up and your fists are clenched. I know your sister just took your toy and that might make you feel angry. Are you feeling angry?" This technique can help your child associate physiological feelings with an emotional label. Once calm, work with your child to repair and reconnect. Share your coping techniques. For example, "I feel angry sometimes. When I get angry, I like to stomp my feet and turn up my music. Do you want to try this with me?" Model this often, either when you're upset or as a teaching moment by pretending to feel angry. Real-life examples help normalize feelings and teach emotion regulation skills. If you acted in a way you regret - yelling, for instance - address it by apologizing and taking responsibility. This grounding can help you and your child move forward. Taking Proactive Preventative Steps While big emotions and corresponding behaviors are a natural part of early childhood, there are steps you can take to help mitigate future meltdowns. Develop a routine and stick to it as much as possible. Children thrive with structure; the unexpected or unknown can lead to emotional dysregulation. That said, there will always be disruptions and transitions - some small (such as an out-of-town houseguest) and some large (like moving or welcoming a new sibling). Discuss these moments in advance to help your child anticipate and prepare for the change. Certain situations, such as the grocery store or a public event, may be triggers for children. Avoiding these situations altogether won't help them learn, so prepare them with social scripting. Tell a story about the situation, discuss what they'll experience and how they might feel and label the emotions. This talk can reduce anxiety, build confidence and make the situation more manageable. Additionally, it's important to recognize a child's emotional state can be intertwined with yours; if you're overwhelmed, stressed or anxious, your child may pick up on that and experience some of those same feelings. Likewise, if you're calm, your child is more likely to be, too. Finding Helpful Resources When children are not in a heightened emotional state, reading books about characters and big emotions can be helpful. Pause and ask them what they think the character is feeling and if they ever feel that way. Consider "Hammerhead, Mad's Not Bad" and "Felix and the Picnic."     The Rebbe: 32 Years Later, His Influence Continues To Shape the World By Rabbi Moishe Kievman Chabad Chayil Jun 25, 2026 The 3rd Of Tamuz, Observed This Year On Thursday, June 18th, Marked The 32nd Yahrtzeit (Hilula) Of Rabbi Menachem Mendel Schneerson, The Lubavitcher Rebbe. Known Simply As “The Rebbe” To Millions Around The Globe, He Was The Most Influential Jewish Leader In Modern History, And Arguably The Most Impactful Rabbi Of All Time. Through a worldwide network of emissaries serving in every corner of the globe, the Rebbe’s vision and teachings continue to touch the lives of millions. His influence can be found in bustling cities and remote villages, in universities and hospitals, in government offices and family homes. In the aftermath of the Holocaust, when many feared Judaism faced an uncertain future, the Rebbe inspired a remarkable renaissance of Jewish life. He encouraged Jews everywhere to embrace their heritage with pride, joy, and optimism. More importantly, he demonstrated those values through his own life. His message of personal responsibility, love for every Jew, and unwavering faith helped revitalize countless individuals and communities, forever changing the trajectory of Jewish history. The Rebbe took extraordinary responsibility for the material and spiritual welfare of Jews worldwide. He played a crucial role in supporting and rescuing Jewish communities in the Soviet Union, Morocco, Iran, and elsewhere, while simultaneously reaching Jews in places as distant as Alaska, Curaçao, and Japan. Leaders of Israel regularly sought his guidance on matters ranging from education and public health to military strategy, economics, and international relations. Yet despite his global stature, the Rebbe never lost sight of the individual. Every person mattered. Growing up in Crown Heights, Brooklyn, just a few blocks from the Rebbe, I was privileged to see him regularly. I prayed in his synagogue, sang at his farbrengens, attended his public gatherings, and eagerly sought every opportunity to catch a glimpse of him. As a child, I would watch thousands of people travel from around the world to seek his counsel, hear his teachings, or simply be in his presence, and I remember thinking how privileged I was to live right there. One of the most memorable sights was Sunday Dollars. For hours each week, the Rebbe stood and personally greeted thousands of people from every walk of life, giving each person a dollar to donate to charity along with a blessing. People treasured those moments. Most would replace the dollar with one of their own for charity and keep the Rebbe’s dollar as a cherished reminder of his blessing. I vividly remember the lines of thousands going around the block. The Rebbe’s accessibility was extraordinary. Statesmen, scholars, artists, and world leaders sought his counsel. Among those who met with him were President Ronald Reagan, Senator Robert F. Kennedy, Prime Ministers Menachem Begin and Yitzchak Rabin, Nobel Laureate Elie Wiesel, and musician Bob Dylan. Yet the same attention and care shown to public figures was extended to every individual who crossed his path. His concerns extended far beyond the Jewish community. The Rebbe spoke passionately about education, moral values, care for the vulnerable, family life, ethical government, and social responsibility. He advocated for a universal moral code based on the Seven Noahide Laws and believed that the timeless wisdom of the Torah remained as relevant in modern society as it was 3,338 years ago at Mount Sinai. Today, the Rebbe’s teachings have become deeply woven into the fabric of Jewish life and continue to inspire people of all backgrounds. More people than ever are studying his teachings, participating in Jewish life, and embracing his vision of bringing goodness, kindness, and spiritual awareness into the world. Thousands visit the Rebbe’s synagogue at 770 Eastern Parkway and his resting place, known as the Ohel, each week. There, people pray to G-d for guidance, blessing, and inspiration. The Ohel has become a destination not only for Jews but for leaders and people of all faiths. In 2013, then-Newark Mayor Cory Booker visited the Ohel on the eve of his election to the United States Senate. Before his election campaigns, President Donald Trump sent family members to pray there on his behalf and later visited personally. Argentine President Javier Milei visited before his election and continues to return before major decisions. On any day, at any hour, visitors from around the world can be found praying at this sacred site. The Rebbe’s scholarship was equally remarkable. His teachings encompass every area of Torah study, including Jewish philosophy, theology, biblical commentary, Talmud, Kabbalah, ethics, and practical guidance for daily living. At Chabad Chayil, we are privileged to study the Rebbe’s teachings together every Shabbat following Kiddush. Each week explores a different topic and offers fresh insights, fascinating ideas, and practical inspiration. Everyone is welcome to join. Despite the tremendous respect and admiration he commanded worldwide, the Rebbe lived with striking simplicity. While overseeing a vast network of institutions and activities, his own synagogue remained modest and unassuming. As a child, I often wondered why such a great leader prayed in such a simple building. I remember promising myself that one day, if I could, I would help beautify it in a way befitting its significance. In the coming weeks, Jewish communities around the world will commemorate this special day with gatherings, classes, farbrengens, and acts of kindness. I encourage everyone to connect with their local synagogue or Chabad center and, even more importantly, to undertake an additional mitzvah or good deed in honor of the Rebbe’s legacy.
