Engineered Life Safety Systems Milestones

This Week, I Was Copied On An E-Mail In Regard To Notices Of Violations Going Out To Some Condominiums That Have Not Hit The Required Milestones For Their ELSS, Engineered Life Safety System. For Many Years State Legislation Has Required Buildings To Install Sprinkler Systems.

Over those years many condominium boards and owners were hoping that this requirement would be voided or further delayed. It was delayed but only by a year.

Condominiums were required to decide by January 2025 how they were going to proceed with implementation. There were two alternatives. The one is a sprinkler system and the other an advanced life safety system. These plans can only be performed by professional Florida Engineers and approved by our local Fire Marshals.


I personally was asked to come out and attend some condominium meetings where this was the topic. Even during those meetings there were people still questioning if their board had to fulfill this state mandate. Just like other assessments for 40 and 50-year milestones individuals actually were challenging boards and threatening to vote them out. In some cases, the president themselves was not making the decision. Sadly, delays in projects of this nature end up costing more money and in these cases notices of violations.


Owning a condominium myself, I understand how impactful these improvements can be to budgets and many struggling individuals. The law is the law. When I attended meetings, I made it a point to make sure our Fire Marshal answers every technical question. As of this past January 2026 each condominium was required to have not only the plan but to have entered into a contract and have a permit. Every condominium is to have their ELSS operational and be inspected by January 2027.


So, what happens in these cases? The properties not in compliance were issued a violation. The Marshal follows up to see if the board or management is taking any action to move forward. If they are the Marshal will continue to monitor.


So, what if nothing is done? The Fire Marshal will proceed with enforcement action. There are a few measures that can take place. Building could be fined. Any existing permits could be revoked. No other work permits will be issued for the building. The Marshal could also revoke occupancy. Obviously, this would be the last resort, and this is not our objective. The goal is compliance.


Many building presidents without professional manager do not realize the ramifications of code enforcement. Particularly, where fines are accrued the lack of compliance globally impacts the entire condominium. I know these are struggling times for many. Our city understands that as well. In these cases, the state law is state law. Our Building Official and Fire Marshals are required to ensure the applicable laws are followed.
